As a fan of the band and the music, and when it seemed no album was comming out for years on end, I too was happy to hear new songs that I had never heard before. But why should my excitment at that mean I think that the person who distributed them acted within the law? In terms of the law he did the wrong thing. For us fans who wanted the songs, he did what we wanted. One thing has nothing to do with the other to me. Like Robin Hood gave money to the poor - but he still stole it!

My point wasn't that people should think he acted within the law. I just think it is a joke for people to treat him like a common criminal when they benefitted from these leaks. He would have never done it if he didn't have a hungry audience that was dying to hear these longs. What he did was legally wrong, but I think it is a bit hypocritical to disparage the man if you listened to his leaks.

He signed a confession. What a moron. I think they went after him because of his connection to Universal. They will probably use him to get to the person who gave him the songs.

The only thing I can think of why it would delay it is if this does have an impact on their negotiations for an exclusive release. If this leak somehow cost them millions of dollars then Universal/Azoff might try to convince Axl to re-do the tracklisting. I am sure Universal wants to squeeze out every penny they can on this fiasco of a project. Like I said this is just my speculation, but there is a ton of money tied up in this project so I wouldn't be shocked if something like this did happen.

Before today's events I always thought it was just a convenient excuse for Axl. Maybe it is.

I definitely think it was more the doing of Universal and/or Azoff than it was Axl's, but I am sure he supports what is going on.

Just my speculation, but it is possibly those leaks impacted their negotiations because maybe Best Buy and Walmart weren't willing to pay as much for songs that are widely available on the net.

One thing to keep in mind is that Skwerl isn't your average fan like those of us posting on forums. He was an employee of Universal at one point and I believe this was a leak coming from someone in the industry. That might have pissed them off more than anything.

No, that's absolutely incorrect. Like I said it is his constitutional right to remain silent. It would be unconstitutional for a judge to determine the sentencing based on whether he exercised that right when they went to question him. If he had an attorney at that time the attorney would have instructed him to remain silent.

Now that he is charged they can offer him incentives in terms of sentencing to talk/cooperate but they can't penalize him for exercising his right to talk when they questioned him.

In one way it is hard to feel sorry for him for being so stupid and not protecting himself, but I just can't get behind this prosection since we the fans have benefitted from his actions. I know what he did was wrong , but I don't think he should be punished for helping out a desperate fan base.

No, he just aided in his own prosecution. He should have exercised his right to remain silent. The worst they could have done for exercising his constitutional right was to go and get a warrant. Of course he probably was screwed anyway since he leaked it on his site, but what did he expect to gain by telling them he did it? That they were going to thank him for being honest  and let him go?

I figured that's what probably would happen. The charts are based on how many units are shipped to stores so they won't count the units that are sold. So if they ship 1 million it will count as 1 million sold regardless of how many that are actually sold. That's how I understand it to work.

Soundscan, on the other hand, keeps  track of the number of units sold rather than how many are shipped.  Its not an exact science, but this will be the most interesting number if CD is ever released.

On another note I noticed AC/DC is selling their album on their web site w/ free shipping so if GNR signs an exclusive deal they will hopefully give us the option of purchasing it online than being forced to buy it at Walmart or Best Buy.

It's not only a slap in the face to the old band, but it is to the new band for constantly making them live under the shadow of the old band. I know that's somewhat unavoidable since they are using the name the own band made famous, but let their music stand on its own.

Not to mention I'd be pissed that we got ripped off with some cover tracks as the bonus rather than new material/unheard demos.

I don't want to hear this anyway. What's the point in a re-recorded AFD? To see if they can play it note for note?
